DXChrono Desktop – End User Licence Agreement (EULA)
1. Parties
This End User Licence Agreement (“Agreement”) is between you (“User”) and Peter Goodhall trading as Magicbug (opens in new tab) (“Licensor”).
2. Licence Grant
Upon payment of a one-time fee of £15, the Licensor grants the User a non-exclusive, non-transferable, perpetual licence to install and use DXChrono Desktop.
The licence permits activation on up to five (5) devices, each of which is linked to a unique hardware identifier.
3. Device Activation
Each installation of the software generates a hardware-based identifier (“Hardware Hash”). A valid licence key may be used to activate the software on up to five (5) unique devices.
The User must not:
- Circumvent or attempt to bypass the activation system
- Share licence keys beyond the permitted device limit
- Manipulate hardware identifiers to obtain additional activations
4. Licence Restrictions
The User must not:
- Copy, distribute, resell, or sublicense the software
- Reverse engineer, decompile, or modify the software
- Remove or alter copyright or branding notices
5. Intellectual Property
All intellectual property rights in DXChrono Desktop are owned by Peter Goodhall t/a Magicbug (opens in new tab). This Agreement grants a right to use the software only and does not transfer ownership.
6. Payment and Refunds
The licence fee is a one-time payment of £15. All purchases are final, except where a refund is required under applicable law.
7. Use at Own Risk
The software is provided “as is” and is used entirely at the User’s own risk. The Licensor makes no guarantees regarding performance, availability, or fitness for a particular purpose.
8. Limitation of Liability
To the fullest extent permitted by law, the Licensor shall not be liable for:
- Loss of data
- Loss of profits or business
- Indirect or consequential damages
Nothing in this Agreement excludes or limits liability where it is unlawful to do so, including liability for death or personal injury caused by negligence.
9. Termination
This Agreement terminates automatically if the User breaches its terms. Upon termination, the User must cease all use of the software.
10. Updates and Support
Updates and support may be provided at the Licensor’s discretion and are not guaranteed.
11. Governing Law
This Agreement is governed by the laws of Scotland, and any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
12. Acceptance
By installing or using DXChrono Desktop, the User confirms that they have read and agree to be bound by this Agreement.
